Terms & Conditions – Business Loan Application
By submitting this Business Loan Application, you ("Applicant") agree to the following terms and conditions:
1. Application and Agreement
a. Submission of this form constitutes your request for a loan from Swift Capital ("Lender") and does not guarantee approval or funding.
b. All information provided must be accurate, complete, and truthful. The Lender reserves the right to request additional documentation or clarification at any time.
2. Use of Information
a. You authorize Swift Capital to verify all information provided, including but not limited to business operations, financial statements, credit history, and contact details.
b. The Lender may share application details with credit bureaus or third-party service providers for evaluation purposes.
3. Loan Terms
a. Any loan offer—if extended—will include a written outline of terms, including the loan amount, interest rate, repayment schedule, fees, and collateral (if applicable).
b. Applicants must review and accept these terms before disbursement.
4. Purpose of Loan
a. The loan must be used solely for the stated business purposes outlined in the application.
b. Misuse of funds may result in termination of the loan and require immediate repayment.
5. Repayment and Fees
a. Loan repayment will follow the schedule and amounts specified in the final loan agreement.
b. Late repayments may incur additional fees or default interest, as outlined in the formal offer.
6. Default and Remedies
a. Failure to meet obligations may result in default, requiring immediate repayment and enforcement of collateral.
b. The Lender may also suspend access to additional financing or services.
7. Representations and Warranties
You represent and warrant that:
- Your business is duly formed, validly existing, and in good standing.
- You have the authority to enter into agreements on behalf of the business.
- This application does not conflict with other agreements or obligations.
8. Privacy and Data Protection
Your data will be handled according to Swift Capital’s Privacy Policy. You consent to the collection, storage, and processing of your personal and business information for purposes of loan evaluation.
9. Governing Law
This application, and any subsequent loan agreement, shall be governed by the laws of Malawi.
10. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
